We understand that issues can arise when you have lived with someone. This is called cohabitation.

You need to know that if you live together you do not acquire the same rights as married couples and that this applies however long you have lived together.

It is therefore important to ensure that the home you share is owned jointly by both of you as your interest in that home will be determined in most cases by the legal ownership of the property as provided for when the property was bought.

If the property you have shared is owned by your ex-partner then there may be an argument to say that you have acquired a beneficial interest in that property. You will need specialist advice to establish such an interest.

We would advise you to consider reaching agreement on the legal/beneficial ownership of any property you share as early as possible in your relationship however if you have not done so then you should seek advice as soon as possible after the breakdown of your relationship.
