Estate Planning

When a person dies, someone needs to deal with their estate to ensure realisation of their assets, to sell or transfer their property and to discharge any debts.

Following this, the estate then needs to be distributed in accordance with the deceased's last will and testament (if they left one) or in accordance with the law if they did not leave a will.

In order for all the above to be possible, a Grant of Probate will usually be required. We have a dedicated team who can deal with all matters in relation to the estate expeditiously and with sensitivity at such a difficult time. We will do our utmost to ensure that all matters are taken care of and to alleviate the pressure of dealing with such matters.

What does Administration Require?

For our probate team to deal with the administration expeditiously and sensitivity at such a difficult time we undertake the following for you:

  • Obtain details of all assets and liabilities.
  • Preparing the necessary tax forms.
  • Going through with you the last will of the deceased or explaining the law where a will was not made.
  • Obtaining a grant of probate or letters of administration so that assets can be realised.
  • Dealing with the liabilities of the estate including all tax liabilities.
  • Distributing the estate which is the difference between the assets and liabilities of the deceased how the law states or as per the terms of the will.

We do this with the upmost care to ensure that the pressure of dealing with such matters is not on your shoulders but on ours.

In certain circumstances there are times when disputes arise between people involved in the administration of the estate and there can be challenges to an estate.  If this does occur then we can advise upon this.  If you require advice upon this then please make an appointment to see one of our specialist team and ask for a free initial consultation.
