Actions Against the Police: Nelson & Burnley


We have over a number of years had dealing with the police by being one of the most pro-active firms in dealing with Defendant who have been arrested by the police. W e have found that as well as Defendants being arrested by the police that with our experience in criminal work we can spot where the police do not follow procedures and can advise our clients upon whether or not they have actions against them.

Civil Action

We understand that at times the police do not do as they are supposed to and that we have dealt with claims for assault, false imprisonment and malicious prosecution.  We have dealt with claims that have been for high profile people in the East Lancashire area.  We understand that these claims can have a significant value whereby the police have committed a wrong doing.

Police Complaints

We understand as well that at times compensation is not what is required by people who are arrested or have dealings with the police.  Sometimes people just want to just complain about the way that the police have dealt with a matter.  If we are dealing with a complaint then we advise you to make the complaint to an inspector within the police area concerned.  The police will then want to interview you about that complaint and any relevant witnesses.  The investigating officer should then interview the police officers and a decision then made as to the way to proceed with that complaint.  In serious cases this can include the police reporting matters to the Crown Prosecution Service who can decide to bring proceedings in this matter.  Alternatively matters can be reported to the Independent Police Complaints Commission.  If you require advice upon this then please contact us.

Wrongful Conviction

In certain circumstances where someone is charged and acquitted they are under certain procedures allowed to apply to the Home Office for compensation.  If you have been wrongly charged and dealt with through the court process we would always contact the Crown Prosecution Service and ask them for details as to what happened with your case.  We would then write on your behalf to the Home Secretary for possible compensation on your behalf.  If the Home Secretary refuses that then there are certain circumstances when we can review his decision judicially.  If you require advice upon these matters please contact us.
